1. Who owns what

  • You own what you create in Diamond Animator. We only get the limited license we need to run the service for you (see the Terms of Service).
  • We own the Diamond Animator app, engine, name and logo.
  • Only use music, characters, images or videos you made yourself or have permission to use.

2. Reporting copyright infringement (DMCA notice)

If you believe something on Diamond Animator copies your work without permission, send a notice to our designated agent under the US Digital Millennium Copyright Act (DMCA). Your notice must include:

  1. Your physical or electronic signature (typing your full name is fine).
  2. A description of the copyrighted work you say was infringed.
  3. Where the infringing material is (a link or enough detail for us to find it).
  4. Your name, address, phone number and email.
  5. A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for them.

False claims can make you legally responsible for damages, so please make sure the material really infringes before you send a notice.

3. Our designated agent

4. Counter-notices

If your content was removed and you believe it was a mistake or you had permission, you can send a counter-notice to the same address with:

  1. Your physical or electronic signature.
  2. What was removed and where it was before.
  3. A statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification.
  4. Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal court for your district (or, if you are outside the US, any district where we may be found), and that you will accept service of process from the person who sent the original notice.

We will send your counter-notice to the person who complained. If they don’t tell us they have filed a court action within 10 to 14 business days, we may restore the content.

5. Repeat infringers

We close the accounts of users who repeatedly infringe other people’s copyrights, in appropriate circumstances.
